Terms & Conditions
These Terms and Conditions are the standard terms for the provision of services by Aventura Safaris Ltd, a company registered in England under 08500332 of The Bristol Office, 2nd Floor, 5 High Street, Westbury-on-Trym, Bristol, BS9 3BY (referred to herein as Aventura).
1. The Contract
1.1 During the booking process, you may receive several quotations as you and Aventura discuss what the best arrangement are for you. A contract will exist between you and Aventura as soon as we issue our booking confirmation. All bookings are made subject to these terms and conditions.
1.2 Most quotations for packages are based on 2 people sharing (although they may be given on a per person basis). If you are travelling as a single person, you should make Aventura aware of this as it will affect the price.
1.3 Once you have received your booking confirmation, it is your responsibility to check that the information and booking details, including the spelling of all passenger names, as stated on your invoice are correct.
1.4 When you make a booking you warrant to Aventura that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions.
1.5 We reserve the right to refuse to accept and/or not proceed with any booking at any time at our sole discretion.
2. Memberships
2.1 We are a Member of ABTA, membership number Y6136. We are obliged to maintain a high standard of service to you by ABTA’s Code of Conduct. We can also offer you an arbitration scheme for the resolution of disputes arising out of this contract. The scheme is arranged by ABTA and administered independently. It is a simple and inexpensive method of arbitration on documents alone with restricted liability on you for costs. The upper limit on claims is £5,000 per person and £25,000 per booking form. The scheme doesn’t apply to claims which are solely in respect of physical injury or illness or their consequences. It can however deal with claims which include an element of minor injury or illness subject to a limit of £1,500 on the amount the arbitrator can award per person in respect of this element. Your request for arbitration must be received by ABTA within eighteen months of the date of return from holiday. For injury and illness claims, you can request the ABTA Mediation Procedure and we have the option to agree to mediation. Further information on the Code and ABTA’s assistance in resolving disputes can be found on www.abta.com.
2.2 We provide full financial protection for our package holidays, by way of an insurance policy with Mapfre.
2.3 Aventura is also a member of the Tanzania Association of Tour Operators (TATO) which is the only government recognized representative for tour operators in Tanzania. As a member of TATO, Aventura pledge to adhere by its Code of Ethics. For further information on TATO, contact Tanzania Association of Tour Operators, School Rd, Arusha, P.O. Box 6162, Tanzania.
3. Price and Payment
3.1 We try to ensure that the price of your trip will not change once a contract exists between us. However, in exceptional circumstances Aventura reserve the right to amend the price. Such circumstances include, but are not limited to: –
3.1.1 where the booking was confirmed prior to confirmation of suppliers prices and we informed you of this; or
3.1.2 changes in regulatory fees and taxes at your destination; or
3.1.3 significant currency fluctuations.
3.2 At the time of booking you must pay a deposit of 30% of the total price of the booking.
3.3 The balance of the price of your booking must be paid at least 60 days before your departure date, or as advised at the time of booking and stated on our booking confirmation.
3.4 If the deposit and/or balance is not paid in time, we reserve the right to cancel your booking. If the balance is not paid in time, we shall retain your deposit.
3.5 We may charge you interest on the overdue sum at the rate of 5% per annum above the base lending rate of HSBC Bank Plc from time to time. Interest will accrue on a daily basis from the due date for payment until the actual date of payment of the overdue sum, whether before or after judgment. You must pay any interest due when paying an overdue sum.
3.6 We accept the following methods of payment: bank transfer, bankers draft, Paypal, Credit/debit cards. We may make a charge for balances paid by credit cards to reflect the charges levied by credit card companies.
4. Cancellations & refunds
4.1 You may change your booking at any time but we may charge a fee to cover the administrative costs of the changes which can be quite significant and so we advise you to avoid changes if at all possible.
4.2 If your booking is changed, Aventura will inform you of any change to the booking price in writing and include details of any change to your required deposit and or balance payment.
4.3 You may cancel your booking by notifying us in writing of your intention to do so. In the event of you cancelling your booking, the following charges will apply:

35 days or more prior to departure date 35% of the booking price retained by or payable to us
15 to 34 days prior to departure date 50% of the booking price retained by or payable to us
14 days or less prior to departure date 100% of the booking price retained by or payable to us payable to Us
4.4 No refund will be payable in the event that you seek to cancel your booking (or any part of your booking) on or after your departure date.
4.5 Please note that if the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.
5. Changes to bookings
5.1 Circumstances occur when changes are required to your booking after it has been made and a contract exists between us. Whilst we will always try and accommodate any such changes, sometimes this isn’t possible.
5.2 You may be asked to pay an administration charge and will of course be liable to pay any further cost we may incur in making your required change. You should be aware that these costs could increase the closer to the departure date that changes are made and you should therefore contact us as soon as possible.
6. Changes or cancellation by Aventura
6.1 In the unlikely event of us having to make changes to your booking (usually due to changes imposed on us by third parties or unforeseeable circumstances), we reserve the right to do so at any time.
6.2 The nature of the market and region we operate in creates some unpredictability and circumstances occasionally arise where the accommodation you book with us becomes unavailable (particularly where the booking is made close to the date of departure during high/peak season). If this is the case, we will endeavour to place you in accommodation of a similar standard and quality and will make you aware of this. Your booking is made with this risk within your knowledge and Aventura will accept no liability for such circumstances arising.
6.3 We shall endeavour to advise you of any changes as soon as we are aware of them.
6.4 We also reserve the right in any circumstances to cancel your travel arrangements.
6.5 We will not cancel your travel arrangements less than 64 days before your departure date, except for reasons of force majeure or failure by you to pay the final balance.
6.6 If we are unable to provide the travel arrangements in accordance with your booking we will either: –
6.6.1 offer you a full refund of all monies paid; or
6.6.2 offer you alternative comparable travel arrangements.
6.7 Please note that we do not have any responsibility or liability for any consequential loss you may incur from arrangements you have made with any other party or parties.
6.8 Once your travel arrangements have commenced, it is sometimes necessary to alter your itinerary in response to unforeseeable circumstances (usually the weather). Aventura reserve the right to substitute certain travel arrangements should it be considered, in our reasonable opinion, necessary for your safety and enjoyment.
6.9 Aventura shall not be in breach of its agreement with you, nor liable for delay in performing, or failure to perform, any of its obligations under such agreement if such delay or failure result from events, circumstances or causes beyond its reasonable control (including but not limited to acts of God, flood, drought, earthquake or other natural disaster; epidemic or pandemic; terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations).
7. Liability
7.1 Except for liability for death, injury or illness caused by the negligent acts and/or omissions of our employees or agents, or suppliers and subcontractors, whilst acting within the scope of, or in the course of their employment, in the provision of your travel arrangements, Aventura accept no further liability.
7.2 Our liability in all cases shall be limited to a maximum of the cost of your holiday.
8. Traveller responsibilities
8.1 Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements.
8.2 You are responsible for ensuring that any existing medical conditions or disabilities which may require assistance are declared to us before you book your holiday for you and your party or, if newly diagnosed, immediately after diagnosis but no later than 48 hours before departure. This is essential for all bookings.
8.3 You must be responsible for the behaviour of yourself and your party. We reserve reasonable discretion to refuse your booking or to remove you or a member of your party from any tour or holiday, if your demeanour or behaviour, or that of a member of your party, is disruptive, dangerous or annoying to other people. No refund or payment of any costs incurred by you will be made by us under these circumstances.
8.4 You are responsible for the carriage and care of your luggage throughout your holiday. Please ensure that your luggage is loaded on to all transport and be careful to take the correct luggage with you when you leave any mode of transport.
8.5 Safari’s are inherently dangerous due to the fact that you are likely to be visiting the natural habitat of wild animals. You must respect this and exercise appropriate caution. Your booking is accepted on the condition that you understand and accept these inherent risks.
8.6 Aventura does not arrange air or other transport to or from Tanzania. It is your sole responsibility to book such transport arrangements and Aventura accept no liability whatsoever in respect of such transport arrangements.
9. Insurance
9.1 You should obtain insurance through a reputable insurer which is adequate and appropriate for the travel arrangements you book with us including, but not limited to, comprehensively covering medical expenses, loss/damage to property and other personal risks. You accept full responsibility for ensuring that all members of the named party comply with this clause. Your insurance should cover any activity you choose to participate in while on holiday (e.g. hot air ballooning, white-water rafting, etc.) which could be deemed as being of a hazardous nature.
9.2 The organisers of some adventure activities that you may choose to take part in whilst on holiday may request you to sign a waiver of their liability for risks involved. By signing such a document you may well lose any rights to claim for damages in respect of death, injury, or loss of or damage to property even if negligence on the part of the activity organiser is proven to have occurred. Aventura take no responsibility for activities booked and provided through independent third parties.
10. Data protection
Your booking will inevitably require us to obtain and process personal information. We take protection of your personal data very seriously. We do have to pass your details on to various suppliers and third parties (such as accommodation or transport providers). We will not, however, pass any information on to any person not responsible for part of your travel arrangements. In making your booking, you consent to this information being passed on to the relevant persons. You should be aware that where your holiday is outside the European Economic Area (EEA), controls on data protection may not be as strong as the legal requirements in this country.
11. Complaints
If you wish to make a complaint about anything to do with your travel arrangements, in the first instance please inform the relevant supplier, for example the hotel or the transport supplier. This allows us the opportunity to put things right immediately. If your complaint remains unresolved then please contact us in the UK and we will endeavour to resolve it as soon as we are able to do so.
12. Governing Law
These Terms & Conditions apply to all bookings and shall be governed by, and construed in accordance with, the laws of England and Wales. Any dispute relating to your booking or these Terms & Conditions shall fall within the exclusive jurisdiction of the courts of England and Wales.
